Scope

These GTC apply to all training and continuing education services offered publicly by Axxos AG (hereinafter: “Axxos”), either alone or together with one or more training partners. In the event of conflicts between the GTC of a training partner and these GTC, these GTC take precedence. These GTC generally do not apply to in-house, non-public training and continuing education events (in-house training). For these, the individually agreed contractual conditions apply. Axxos reserves the right to adjust these GTC at any time. The version valid at the time of registration for a specific event applies. The current GTC can be viewed at any time on the Axxos website.

Services

Axxos provides training and continuing education services (e.g., in the form of seminars) according to the respective announcements or customer agreements. Axxos reserves the right, in exceptional cases, to adjust the agreed contents and implementation for learning-specific reasons if this would achieve the training goal for the participants more optimally. If announcements or customer agreements contain provisions that deviate from these GTC, they take precedence over the GTC.

Registration

Registration for a specific event is binding and must be made in writing (letter or email). Notwithstanding this, registration does not guarantee participation. The contractual relationship between the participant and Axxos is established when the registration is confirmed in writing by Axxos (email). Registrations are considered in the order they are received. Axxos reserves the right to cancel or postpone continuing education if there is an insufficient number of registrations (see “Cancellation”).

Withdrawal/Cancellation

A cancellation must be made in writing (letter or email) and is considered a withdrawal from the contractual relationship between the participant and Axxos. For withdrawals up to 10 calendar days before the start of the respective event, 30% of the participation fees are due. For later cancellations and no-shows, the full amount is due, and no refund is provided. In case of prevention, the registration can always be transferred to another person at no additional cost. The respective participation requirements must also be met by the substitute participant.

Rebooking

Rebooking to another training or continuing education event must be made in writing (letter or email). Rebooking is possible without cost if it occurs at least 3 weeks before the start of the respective event. Later rebookings will incur an administrative fee of CHF 200. In the event that the person is unable to participate due to illness or accident (medical certificate required), Axxos may waive the administrative fee.

Partial Attendance

If a participant attends only part of a training or continuing education event, no refund of participation fees will be made, and there is no entitlement to a participation certificate. This applies regardless of the reasons for the partial attendance.

Cancellation

Axxos is entitled to cancel training and continuing education events at any time, especially if the minimum number of participants is not reached. In such cases, participants will be informed at least two weeks before the start of the event. Participation fees already paid will be fully refunded. There is no entitlement to further compensation.

Non-fulfillment

If a training or continuing education event cannot be conducted due to force majeure (e.g., accident or illness of an instructor), the event will be rescheduled. Participants who cannot attend the rescheduled date are free to withdraw from the contract; they are entitled to a refund of the participation fee, provided the withdrawal is communicated promptly after notification by Axxos.

Copyright and Intellectual Property

All copyrights and other intellectual property rights to the information and materials from the training and continuing education events belong to Axxos or the respective instructors. The information and materials may only be used for personal use. Further use is only permitted with prior written consent from the rights holder.

Payment Terms

For the invoiced training and continuing education services, a payment term of 30 days from the invoice date applies. If invoices are not paid on time, participants may be excluded from the respective event. The obligation to pay the invoice remains unaffected.

Data Protection

If Axxos processes personal data of participants, this is done in compliance with the applicable data protection regulations. Certificates

Axxos is EDUQUA certified, as are all training and continuing education events. All participants receive a training certificate, which serves both as confirmation of participation and as proof of attendance at the EDUQUA certified training.

No Advisory Relationship

The services provided by Axxos in the context of training and continuing education events do not constitute advice or similar services. No corresponding contractual relationship is established between the participants and Axxos, and Axxos assumes no corresponding liability.

Insurance

For all training and continuing education events offered by Axxos, each participant is responsible for their own adequate insurance coverage (accident, liability, etc.). Axxos assumes no liability for theft or loss of items.

Final Provisions

All relationships to which these GTC apply are subject to Swiss law. In the event of disputes, an attempt at an amicable settlement must always be made first. Otherwise, the place of jurisdiction is Aarau.
